The State of North Carolina called 58 witnesses to establish its case against Ronnie L. Kimble, one of which was withdrawn. Function: (1) Document Ted Kimble’s efforts to increase Patricia’s life insurance. (2) Document Patricia’s angry reaction when she found out. (3) Document Ted’s efforts to collect on life insurance after Patricia’s death.
  His testimony was interrupted during Direct Examination for a hearing on hearsay exception to conspiracy.

Function: Document absence of latent finger prints on the gas can found in the kitchen.

Function: Document that analysis of latent prints lifted from Patricia’s car and the boat yielded only one latent print of value, it did not match either Ted or Ronnie Kimble, and no match was obtained from the State’s AFIS database.

Function: (1) Document that Ted dated her from end of February into May 1993. (2) Document that Ted owned the Glock gun and bought her a hand gun and took her to target practice to teach her how to use it.

Function: Document that Patricia called her 2-3 weeks before her death and expressed concern about the state of her marriage, Ted not wanting to spend time with her anymore, taking a 2nd job, wanting to buy a motorcycle, and using profanity and other bad language.

Relationship: Patricia’s good friend and Matron of Honor
Function: (1) Document that Patricia called her 2-3 weeks before her death and told her about the insurance Ted forged her name on, in case something happened to her, and that she was scared. (2) Document Ted’s desire to buy a motorcycle and he had gotten the 2nd job to pay for it.

Relationship: Patricia’s friend; wife of Gary Lyle, who sold Lyles Building Material to Ted and Patricia.
Function: Document Patricia’s phone call, the fear in Patricia’s voice, Patricia crying, saying Ted was not the man she married and all he cared about was money, she found a life insurance policy for which Ted forged her name, Ted slept with a gun under his pillow and she wondered each night if she would wake up in the morning.

Relationship: Ted’s employer; sold Lyles Building Material to Ted and Patricia.
Function: (1) Document phone call from Patricia Rose Lyles testified to; talked about the insurance; Ted wanted to buy a motorcycle to ride up and down High Point Road; the $5,000 worth of extras he had put on their Jeep; he agreed to talk to Ted at the marriage retreat in a couple of weeks. (2) Document that he wouldn’t have sold the business to Ted if he weren’t married.
 

31. Brian Beaupre
Relationship: Human Resources Manager, Precision Fabrics
Function: (1) Document Ted Kimble’s application for employment and his work history with the company. (2) Documented that Oct 2-6, Ted was in orientation during the 1st shift, 1st day on 2nd shift was the 9th, and he arranged to come in late, at 6 pm instead of 3 pm. (3) Ted on unpaid eave between October 9th and November 27th, at which time he was terminated.
 

32. Michael Fayne Chambers
Relationship: Shift lead man, 2nd shift, lamination department, Precision Fabrics
Function: Verify Ted’s presence at Precision Fabrics about 6 pm the night of October 9.
 

33. Stephanie Young Padgett
Relationship: Patricia's friend; daughter of previous witness Nancy Young
Function: Witness withdrawn after admissibility hearing. She would have testified that she had a conversation with Patricia on October 6, 1995, in which Patricia told her she and Ted were about to lose Lyles and that is why Ted took the second job, because they had to come up with a large amount of money.

Relationship: Dated Ted Kimble and Ronnie Kimble; introduced Janet Blakley to Ted Kimble.
Function: (1) Document Ted’s possession of the Glock gun and doing target practice, with Ronnie present.

Relationship: Patricia’s brother; first person on the scene
Function: (1) Document that there were no windows or doors open when he arrived on the scene. (2) Document that there was no new damage on the door from the kitchen to the garage. (3) Document that Patricia was sure to lock the dead bolts after the breaking and enterings.

Function: (1) Document that Patricia was manager of the Cinnamon Ridge apartment complex. (2) Document company insurance for Patricia, $25,000 double indemnity. (3) Document Ted Kimble’s call on October 11, 1995, to ask him to file a claim on Patricia’s life insurance. (4) Document informing Ted that he was not the beneficiary, and being surprised and unhappy about that, and his intentions to ask Sheila Blakley, the beneficiary, to give him the money. (5) Document his call to Sheila Blakley advising her not to give Ted the money.

Function: (1) Ted’s desire to increase Patricia’s life insurance payable to him from $25,000 to $100,000. (2) Pat refused to sign the papers.
 

40. Khalil Michael Ganim

Function: (1) Met with Ted to discuss $50-100,000 insurance on each of them. (2) Ted informed him at a later meeting that Patricia didn’t want additional insurance on herself.
 

41. Janice Lynn Johnson
Relationship: Romantic relationship with Ted Kimble after Patricia's death
Function: (1) She started seeing Ted about 2-3 weeks after Patricia’s death, and they dated for about a month. (2) He brought her to the house and showed her where Patricia’s body was found, and that he was unemotional about it. (3) Ted was very angry that he wasn’t getting insurance money in the amounts he wanted. (4) Ted claimed greater value for the contents of the house on the insurance claims. (5) Witnessed conversation between Ted and Ronnie in which they were both very upset and angry. (6) Ted carried a gun on a continuous basis.

Function: Document that Ronnie said he had gone by Patricia’s house to pick something up or drop something off, and was the last one to see her.

 

44. James Allen Dziadaszek, II
Relationship: Corporal, US Marines, Camp Lejeune; Ronnie Kimble’s co-worker
Function: Document the conversations he had with Ronnie in which Ronnie first told him that on Oct. 9 at 4:00 he returned the truck he had borrowed from Ted to Ted’s house then later changed it to returning the truck to Lyles, not the house, and also asked James if he was trying to get him convicted.

 

45. Joseph D. Reavis
Relationship: Special agent, Forensic chemist, State Bureau of Investigation
Function: (1) Document examined hairs from a weapon submitted on October 12, 1995; head hair and pubic hairs from Patricia Kimble submitted November 21, 1995. (2) Provide expert opinion that the hair from the murder weapon was completely microscopically consistent with the hairs of Patricia Kimble.
 

46. Larry Ford
Relationship: Special agent, forensic chemistry and arson analysis,State Bureau of Investigation
Function: (1) Document examination of a bag of burned clothing, a red plastic gasoline can, and a bag containing burned carpet and liquid received on October 10; several containers of foam padding debris received on October 12. (2) Provide expert opinion that the clothing and padding debris contained residual gasoline.

Function: (1) Document his 40-page interview with Ted Kimble on October 16, 1995, including only one reference to his brother and not by name, and laughing at different times. (2) Document the Proof of Loss provided by Ted Kimble, which is 84 pages plus supporting documents .

Relationship: Associate General Counsel, Life Insurance Company of Georgia and Southland Life
Function: (1) Document the application for $200,000 on the life of Patricia Kimble. (2) Document the Notice of Claim and Demand for payment on the insurance policy in progress. (3) Document other life insurance policies on Patricia, double indemnities, with Ted Kimble beneficiary for two $25,000 policies, and Sheila Blakley beneficiary for a $1,000 policy.

District Attorney Panosh moved the Court to publish the evidence to the Jury.  The Defendant filed a nonsuit, but did not wish to be heard.  Defendant's objections to publishing to the Jury statements from the witnesses who testified.

 

The Defendant called 13 witnesses to counter the State's evidence and establish his innocence.

Function:  (1) Document that Ronnie did not have the smell of gas on his clothes or shoes on October 9.  (2) Document Ronnie's whereabouts the later afternoon and evening of October 9. (3) Document that Ronnie showed no unusual emotions or stress at that time.

Relationship:  Former girlfriend of Rodney Woodberry, Ted Kimble's former employee.

Shephard was not allowed to testify and the Defense attorneys instructed to call Woodberry as a witness if they wanted the information in the record.

Function:  (1) Document that she lived with Kim Kimble during the week while Ronnie was at camp.  (2) Document her relationship with Justin Dobesh.  (3) Document the intimidation of Detective Church and Agent Pendergrass.

The Jury requested to see:  the affidavits or statements from Nichols, Pardee, Ted Kimble, Jerry Clark, Mitch Whidden, Debra Whidden, Jim Stump, and Kim Kimble; and the photographs of the outside of the house.  On second request, the Jury asked to see:  the gas receipt, Winn-Dixie cancelled check, and the transcript of Ronnie Kimble's testimony.  On third request, the Jury asked to see the receipt from Atlantic Mobile Home Supplies.  On fourth request, the Jury refined its request for Ronnie Kimble's testimony to Ronnie's account of where he was on the day of October 9, 1995, and Mr. Panosh's cross-examination of each particular response.
